International Responsibility of International Organizations

Abstract

A widely observed phenomenon on the level of international relations is the increasingly growing role that global organizations play on the international scene through their political, economic, social and human activities. Legal responsibility provisions apply to international organizations insofar as they represent legal persons, and this is contrary to traditional jurisprudence which limits those provisions to sovereign states. The variation of those activities has led to the possibility of harming the interests of national law subjects, which necessitates compensation as the organization has an objective legal standing independent of its members and is responsible for its internationally illegal acts. The fact that the international organization enjoys immunity before national jurisdiction does not mean that it is exempted from responsibility for its acts in relation to member states or other similar entities. International organizations depend in their operation on organs and agents and they are responsible for their agents’ acts within the limits of duty and the latter’s behavior is attributed to the organizations to which they belong. The researcher has conducted this study of the responsibility of international organizations in light of the Draft of the United Nations Convention on International Liability of International Organizations.
