Abstract

The United Nations Convention on Maritime Law of 1982 created the Transit Passage system to end the controversy over the traffic system in international straits which link polarized parts of the world. This system was set as a permanent system that cannot be stopped so as to ensure freedom of navigation in international straits. This has led to a rising criticism of system because of the fear of the riparian countries of the strait regarding their security and safety during the passage of ships and aircraft in the strait on transit. As a result of its importance, the Convention has separated the rights and duties of riparian states of straits. Some exceptions have been made in favor of blameless passage. Despite the fact that the Convention is ratified by many States, this system is still being questioned by many other countries which refuse to ratify it as a result of the existence of this system. Jurists and scholars started to interpret and try to explain the ambiguity surrounding this system which is recognized by most countries of the world.
