الملخص

قضت محكمة تمييز دبي في العام 2013 بإعمال مبدأ الإخلال المبتسر في أحد الطعون التي رفعت إليها في قضية عقارية، على الرغم من عدم اعتراف القانون الإماراتي بهذا المبدأ كما هو الحال في القانون الإنجليزي. يتضمن هذا المبدأ حق الطرف المتعاقد في طلب فسخ العقد قبل حلول أجل تنفيذ الطرف الأخر إن وجدت دلائل كافية تشير إلى عدم تنفيذ الطرف المتعاقد لالتزامه التعاقدي دون أن يحل موعد التنفيذ، ويهدف إلى تجنب الآثار السلبية الناشئة عن هذا الإخلال قبل حدوثه قدر المستطاع. يأخذ القانون الإماراتي بمبدأ الخرق الفعلي للعقد، بالتالي يسجل هذا الحكم سابقة قضائية في دولة الإمارات العربية المتحدة. يناقش هذا البحث ماهية هذا المبدأ وأهميته وتنظيمه في القانون الإنجليزي، ومن ثم بيان الاسس التي استندت عليها محكمة تمييز دبي في حكمها والأسباب القانونية والاقتصادية لهذا التوجه القضائي، لتوصي في النهاية بضرورة النص على مبدأ الإخلال المبتسر في القواعد العامة الناظمة لنظرية العقد، من خلال تعديل نصوص قانون المعاملات المدنية الإماراتي بذات القيود والشروط الواردة في القانون الإنجليزي
