Islamic Ruling on the Parent’s Killing of their Child: Jurisprudence vs. the UAE Criminal Law

Abstract

This study deals with Islamic Ruling on the parents’ killing of their child, most notably in the context of the changes we are witnessing in the economic, social and cultural fields, as well as the technological progress, information boom, communication facilities and other factors that have an impact on social relations, including the relationship of parents with their children. Under some stress conditions, domestic violence may lead to the crime of murder. One such an example is the killing of the child by one of the parents or by a mother who commits adultery. The study of the intents of Islamic ruling on this issue and its appropriateness for contemporary circumstances is therefore needed. The study found out, among other things, that the UAE Criminal Law has adopted the public opinion on this subject which says that a parent shall not be executed by killing his/her child.
