شهدت الآونة الأخيرة تزايدًا في أهمية الذكاء الاصطناعي (AI)، مما دفع الدول إلى تطوير أطر قانونية لحماية الملكية الفكرية المرتبطة بالذكاء الاصطناعي واستغلال المعطيات. تفرق اللوائح الحالية بين الإبداعات التي تتضمن تدخلًا بشريًا وتلك الناتجة عن الذكاء الاصطناعي بشكل مستقل، مما يؤثر على مستويات الحماية القانونية. تختلف التجارب الدولية استنادًا إلى التشريعات المحلية والإطار التنظيمي ومستوى التطور التكنولوجي. تلعب القوانين الدولية، مثل اتفاقية الجوانب التجارية لحقوق الملكية الفكرية واتفاقية روما، دورًا مهمًا في حماية الإبداعات المرتبطة بالذكاء الاصطناعي، وتحتاج إلى تعديلات لاستيعاب الابتكارات الجديدة. كما يبرز التأثير المعياري للذكاء الاصطناعي على قوانين الملكية الفكرية وضرورة تكييف المعايير القانونية لتلائم التطورات التكنولوجية وتأثيرها على المفاهيم التقليدية للإبداع والمبدعين. تأتي دول مثل الولايات المتحدة، كوريا الجنوبية، اليابان، والصين في المقدمة في مجال حماية الابتكار المرتبط بالذكاء الاصطناعي. وعلى ذلك فإن البحث الحالي يحاول إلقاء الضوء على تجارب هذه الدول وأيضا الاتحاد الأوربي في هذا الميدان واستخلاص عدد من التوصيات التي يمكن الاعتماد عليها في التعامل مع تحديات الذكاء الاصطناعي ومنها تحديد دوره في الابتكار وما إذا كان يمكن اعتباره مؤلفًا، والتوفيق بين قوانين حماية البيانات واستخدام الذكاء الاصطناعي في تحليل البيانات الضخمة، والحاجة إلى أطر قانونية دولية متناغمة لحماية الملكية الفكرية المرتبطة بالذكاء الاصطناعي.
